Senate GOP blocks Jan. 6 commission, likely dooming independent investigation

Six Republicans broke ranks to join every Democrat in favor of the bill creating a bipartisan probe of the Capitol riot.

Senate Republicans on Friday blocked a bill that would form an independent commission to probe the Jan. 6 Capitol riot, the first filibuster of the year by the chamber's 50-vote minority.

The 54-35 vote, with six Republicans breaking ranks to join every Democrat in favor, came after Senate Minority Leader Mitch McConnell lobbied his members forcefully against the House-passed commission measure. The vote was delayed through the night by a handful of Senate Republicans who obstructed China competitiveness legislation, though Democrats decided to punt that bill until after the Memorial Day recess week in order to push forward on the commission bill.

Several undecided Republicans came down against advancing the commission ahead of Friday’s critical procedural vote, despite efforts by Sen. Susan Collins of Maine to broker a compromise and last-minute lobbying by the family of fallen Capitol Police officer Brian Sicknick. McConnell took an increasingly hard public and private line against establishing the new panel to probe the Jan. 6 Capitol attack by pro-insurrectionists, dubbing the commission idea “extraneous” on Thursday.

Senate Republicans had not blocked any of Democrats’ bills on the floor before Friday. Democrats lamented the blockade of the legislation, with the memory of the violent insurrection still fresh in the minds of many lawmakers.

“On Jan. 6, we all walked over that broken glass. We all saw the spray paint on the walls. We all stood huddled together in shelter," Sen. Amy Klobuchar (D-Minn.) said on the floor before the failed vote.

The six Republican senators who voted to advance the commission proposal were Lisa Murkowski of Alaska, Susan Collins of Maine, Bill Cassidy of Louisiana, Ben Sasse of Nebraska, Mitt Romney of Utah and Rob Portman of Ohio. All but one of them also voted to convict former President Donald Trump in his second impeachment trial earlier this year. All six received public thanks from Rep. Liz Cheney (R-Wyo.), evicted from her party's House leadership 16 days ago after vocal criticism of Trump and his role in the riot.

A seventh GOP senator who also voted to convict Trump this year, retiring Pat Toomey of Pennsylvania, would have supported advancing the House-passed commission bill had he not been called away from Washington for a family commitment, a spokesperson said.

Given Trump's role in encouraging his supporters to storm the Capitol on Jan. 6, as well as his public opposition to the House-passed commission bill, Democrats wasted no time in tying the Friday filibuster to the former president.

"Donald Trump's big lie has now enveloped the Republican Party," Senate Majority Leader Chuck Schumer said on the floor.

The GOP blockade could put further pressure on senators to consider reforms designed to weaken the filibuster, despite Sen. Joe Manchin's (D-W.Va.) repeated affirmation that he supports a 60-vote threshold to pass most legislation.

Sen. Ben Ray Lujan (D-N.M.), called Friday’s vote one of the “defining moments that all of our colleagues need to take a look at, I think for the good of our country.”

Collins’ efforts to negotiate a compromise to allay some Republicans’ fears about the makeup of the commission failed to gain traction, with many Republicans opposing a separate commission regardless of its form. Democrats were also skeptical of her changes, arguing they already made alterations in the House to address Republicans’ concerns.

The proposed commission, modeled after the 9/11 Commission, would have equal subpoena power and an even split between Republican and Democratic appointees, both top Republican requests.

Romney described his colleagues' filibuster as “unfortunate."

“I think it would be appropriate to have further evaluation of what happened on Jan. 6 and who's responsible and how we can prevent that from happening again,” he said.

Cassidy warned of the consequences for Republicans of a partisan investigation. “The investigations will happen with or without Republicans,” he said, arguing that only Republican involvement would keep them “fair, impartial, and focused on the facts.”

The Senate voted on the Jan. 6 commission shortly before leaving for recess. It’s unclear if the concept might come back up for another vote, or whether Democrats will abandon the commission to pursue their own investigations. Friday’s filibuster, however, likely dooms the prospects of any comprehensive independent investigation into the insurrection.

 Top Democrats are weighing whether to deploy a one-party inquiry into the events of Jan. 6. Such an approach, known as a select committee, would not require Republican support but could be seen as partisan. Speaker Nancy Pelosi did not indicate her plans on that front in an otherwise scathing statement after the GOP filibuster.

“Leader McConnell and Senate Republicans’ denial of the truth of the January 6 insurrection brings shame to the Senate," Pelosi said. "Republicans’ cowardice in rejecting the truth of that dark day makes our Capitol and our country less safe."

House Majority Whip Jim Clyburn said Thursday on CNN that Pelosi should “empower certain committees” or “create a select committee” like the coronavirus committee he chairs to conduct investigations, though he acknowledged there was “no question” Republicans would cast either effort as partisan.

Democrats could also continue with existing committee investigations into the insurrection. FBI Director Christopher Wray is set to testify before the House Oversight Committee next month, and several Senate committees are expected to issue their own reports on the insurrection in the coming weeks.

Klobuchar, who chairs one of the committees set to issue a report, said it would be “no substitute” for an independent commission, calling it an analysis of immediate security fixes rather than a deeper dive into the attack.

Former President Donald Trump’s lies about a stolen 2020 election united right-wing supporters, conspiracy theorists and militants on Jan. 6, but the aftermath of the insurrection is roiling two of the most prominent far-right extremist groups at the U.S. Capitol that day.

More than three dozen members and associates across both the Proud Boys and the Oath Keepers have been charged with crimes. Some local chapters cut ties with national leadership in the weeks after the deadly siege. The Proud Boys’ chairman called for a pause in the rallies that often have led to clashes with anti-fascist activists. And one Oath Keeper has agreed to cooperate against others charged in the riot.

Some extremism experts see parallels between the fallout from the Capitol riot and the schisms that divided far-right figures and groups after their violent clashes with counter-protesters at the “Unite the Right” white nationalist rally in Charlottesville, Virginia, in August 2017. The white supremacist “alt-right” movement fractured and ultimately faded from public view after the violence erupted that weekend.

“I think something kind of like that is happening right now in the broader far-right movement, where the cohesive tissue that brought them all together — being the 2020 election — it’s kind of dissolved,” said Jared Holt, a resident fellow at the Atlantic Council’s Digital Forensic Research Lab.

“Like ‘Unite the Right,’ there is a huge disaster, a P.R. disaster, and now they’ve got the attention of the feds. And it’s even more intense now because they have the national security apparatus breathing down their necks,” he added.

But others believe President Joe Biden’s victory and the Jan. 6 investigation, the largest federal prosecution in history, might animate the militia movement — fueled by an anti-government anger.

“We’re already seeing a lot of this rhetoric being spewed in an effort to pull in people,” said Freddy Cruz, a Southern Poverty Law Center research analyst who studies anti-government groups. “It’s very possible that people will become energized and try to coordinate more activity given that we have a Democratic president in office.”

The insurrectionists who descended on the nation’s capital briefly disrupted the certification of Biden’s presidential win and sent terrified lawmakers running for their lives.

The mob marched to the Capitol and broke through police barricades and overwhelmed officers, violently shoving their way into the building to chants of “Hang Mike Pence” and “Stop the Steal.” Some rioters came prepared with pepper spray, baseball bats and other weapons.

Members of the Proud Boys and the Oath Keepers make up just a small fraction of the more than 400 people charged so far. Prosecutors have narrowed in on the two extremist groups as they try to determine how much planning went into the attack, but authorities have said they’re intent on arresting anyone involved in the riot.

More than two dozen Proud Boys leaders, members or associates are among those arrested. The group of self-described “Western chauvinists” emerged from far-right fringes during the Trump administration to mainstream GOP circles, with allies like longtime Trump backer Roger Stone. The group claims it has more than 30,000 members nationwide.

In the sustained protests last summer over police brutality, their counter demonstrations often devolved into violence. Law enforcement stepped in during a protest in Michigan. Members were accused of vandalizing property in Washington, D.C. Then, during a presidential debate with Biden, the group gained greater notoriety after Trump refused to condemn white supremacist groups and told the Proud Boys directly to “stand back and stand by.”

Chairman Henry “Enrique” Tarrio hasn’t been charged in the riot. He wasn’t there on Jan. 6. He’d been arrested in an unrelated vandalism case as he arrived in Washington two days before the insurrection and was ordered out of the area by a judge. Law enforcement later said Tarrio was picked up in part to help quell potential violence.

Tarrio insists the criminal charges haven’t weakened or divided the group. He says he has met with leaders of chapters that declared their independence and patched up their differences.

“We’ve been through the wringer,” Tarrio said in an interview. “Any other group after January 6th would fall apart.”

But leaders of several local Proud Boys chapters, including in Seattle, Las Vegas, Indiana and Alabama, said after Jan. 6 that their members were cutting ties with the organization’s national leadership. Four leaders, including national Elders Council member Ethan Nordean, have been charged by federal officials with planning and leading an attack on the Capitol. One of Nordean’s attorneys said he wasn’t responsible for any crimes committed by other people.

The Las Vegas chapter’s statement on the instant messaging platform Telegram in February didn’t mention Jan. 6 directly, but it claimed the “overall direction of the organization” was endangering its members.

The Alabama group expressed concern about reports that Tarrio had previously been a federal informant. It was revealed in court records recently that Tarrio had worked undercover and cooperated with investigators after he was accused of fraud in 2012.

“We reject and disavow the proven federal informant, Enrique Tarrio, and any and all chapters that choose to associate with him,” the Alabama group posted online in February.

Tarrio said he suspended national Proud Boy rallies shortly after Jan. 6 in part to focus on helping members facing criminal charges. Tarrio described Jan. 6 as “horrible” but said authorities overcharged his jailed lieutenants and are politically persecuting them.

Meanwhile, 16 members and associates of the Oath Keepers — a militia group founded in 2009 that recruits current and former military, police and first responders — have been charged with conspiring to block the certification of the vote. The group’s founder and leader, Stewart Rhodes, has said there were as many as 40,000 Oath Keepers at its peak, but one extremism expert estimates the group’s membership stands around 3,000 nationally.

Rhodes has not been charged, and it’s unclear if he will be. But he has repeatedly come up in court documents as “Person One,” suggesting he’s a central focus of investigators.

Days after the election, Rhodes instructed his followers during a GoToMeeting call to go to Washington to let Trump know “that the people are behind him,” and he expressed hope that Trump would call up the militia to help the president stay in power, authorities say. Rhodes warned they could be headed for a “bloody, bloody civil war, and a bloody — you can call it an insurrection or you can call it a war or fight,” according to court documents.

On Jan. 6, several Oath Keepers, wearing helmets and reinforced vests, were seen on camera shouldering their way up the Capitol steps in a military-style stack formation. Rhodes was communicating that day with some Oath Keepers who entered the Capitol and was seen standing with several of the defendants outside the building after the riot, prosecutors say.

Rhodes has sought to distance himself from those who’ve been arrested, insisting the members went rogue and there was never a plan to enter the Capitol. But he has continued in interviews with right-wing hosts since Jan. 6 to push the lie that the election was stolen, while the Oath Keepers website remains active with posts painting the group as the victim of political persecution.

Messages left at numbers listed for Rhodes weren’t immediately returned.

Court documents show discord among the group as early the night of the attack. Someone identified in the records only as “Person Eleven” blasted the Oath Keepers in a Signal chat with Rhodes and others as “a huge f—n joke” and called Rhodes “the dumbass I heard you were,” court documents say.

Two months later, Rhodes lamented in a message to another Oath Keeper that the national team had gotten “too lax” and “too complacent.” He pledged to “tighten up the command and control” in the group — “even if it means losing some people,” according to court documents.

After the riot, the North Carolina Oath Keepers branch said it was splitting from Rhodes’ group. Its president, who didn’t return messages from the AP, told The News Reporter newspaper it wouldn’t be “a part of anything that terrorizes anybody or goes against law enforcement.”

A leader of an Arizona chapter also slammed Rhodes and those facing charges, saying on CBS’ “60 Minutes” that the attack “goes against everything we’ve ever taught, everything we believe in.”

The Oath Keepers’ leader has also suggested the group may be facing financial pressures. In an interview posted on the Oath Keepers’ website, Rhodes said it has been difficult for the group to raise money as it’s been kicked off certain websites.

The group also lost the ability to process credit card payments online after the company demanded that Rhodes disavow the arrested members and he refused, Rhodes said in a March interview for far-right website Gateway Pundit. The Oath Keepers website now says it cannot accept new memberships online because of “malicious leftist attacks” and instructs people to mail in applications and dues.

A member of the Oath Keepers was the first defendant to plead guilty in the riot. Jon Ryan Schaffer has also agreed to cooperate with the government’s investigation. The Justice Department has promised to consider putting him in the witness security program, suggesting it sees him as a valuable cooperator in the Jan. 6 probe.

There was very little in the way of vandalism, no assaults as have been alleged by you libz and your fire extinguishers.

There was no arson, no looting, and no murder, or attempted murder from the protesters, a stark contrast to the ironic riots.

Also, there is no allegation that the murdered woman did anything that your heroes in BLM, Antifa, and occupoop did.

In the days before the riot, Walden sent a message to Joshua James, one of a group of Oath Keepers named in an ongoing series of indictments, expressing his interest in joining the quick reaction force, which would be staged to bring guns to the Capitol if necessary, the FBI has stated in documents. Walden states: “I am interested in the QRF team in D.C. I am a former Firefighter, EMT-B and have a K-9 trained for security patrol (82 ib. German Shepherd named “Warrior”) I have a Jump Bag with Trauma supplies and have ALL the necessary 2A gear that the situation may require. PLEASE ADVISE. As soon as I hear from you I can hit the road and join up! " Department of Justice officials said Walden and others rode up in golf carts, and aggressively berated and taunted law enforcement officers in riot gear guarding the perimeter of the building. Walden, James and 14 others are charged with conspiracy.

Southard-Rumsey, who sang at Carnegie Hall in 2013 according to her Facebook page, featured prominently in an early video taken inside the Capitol during the riot, as she confronted police officers and screamed expletives. The FBI stated in federal charging documents that they received the first tip about her on Jan. 11. She had posted on social media that she was going to D.C., saying "We The People are making a declaration ... 1776!!" She traveled with three other people, staying in a rented condo in Williamsburg, one of the travelers told the FBI in an interview. The witness said they weren't able to get close to the area where Pres. Donald Trump was speaking so they walked toward the Capitol. The FBI said the witness said they were separated from Southard-Rumsey and then later found her sitting on the steps on the east side of the Capitol building crying and saying she had gone into the buliding.

In videos taken inside the Capitol, she is seen entering the rotunda at about 2:26 p.m., about six minutes after members of the House and Senate and Vice President Mike Pence were evacuated, court documents state. She is then shown on video moving through Statuary Hall. Then, the FBI stated, she encountered a Capitol Police officer, "Sgt. N.V." and began yelling, including the following statements: "Tell Pelosi we are coming for that bitch." "There's a hundred thousand of us, what's it going to be?" "Last friend, last bullet. What's it going to be." Charging documents state she then pushed the sergeant, who in an eventual interview with the FBI, identified Southard-Rumsey as one of two main agitators in the group that approached him. The sergeant told the FBI Southard-Rumsey also obtained a flag pole, which she used to push against him to back him up against a set of doors, which opened and he fell into a statue and struck his head on the base.

In her home state of Florida, she was familiar to an officer in the FBI's Tampa Field office, after multiple interactions at previous local protests.

What happened

McGrew's identity was confirmed by the FBI because video footage inside the Capitol caught him raising his shirt to wipe his face and exposing a large "King James" tattoo on his belly that had previously been documented in booking photos in 2012. Federal charging documents state he yelled aggressively at law enforcement officers, stating "we're coming in here, whether you like it or not" and "fight with us, not against us." The FBI stated he can be seen on camera lunging forward and striking a law enforcement officer as officers tried to clear the rotunda.

At one point, the FBI said, an officer told McGrew calmly: "Just leave, just leave man, come on," which McGrew responded to by screaming: "You leave. You leave. This is our house." Then, documents state, he struck another law enforcement officer and lunged for the officers baton. The FBI received a tip about his identity the very next day. Although he was arrested in Arizona, it isn't clear where McGrew lives or where the 2012 booking photos were taken.

All of the rioters from DC to MN to OR and beyond should be prosecuted to the fullest extent of the law. However, there is a huge difference between rioting on the streets of Minneapolis or Portland and attacking our nations Capitol with the intent to overthrow the American government. They aren't in the same league and anyone who tries to co-mingle the two is simply trying to take heat off of the QAnon Trailer Trash that attacked our Capitol.

President Donald Trump paid just $750 in federal taxes in both 2016 and 2017, and no federal income tax in 10 of the previous 15 years due to massive business losses, the New York Times reported Sunday. The paper said it had acquired more than two decades’ worth of tax-return data from Trump and his business organization, though it does not include his personal tax returns for 2018 and 2019. The Times said more findings from his taxes would be published in the coming weeks.

It added that Ivanka Trump “reported receiving payments from a consulting company she co-owned, totaling $747,622, that exactly matched consulting fees claimed as tax deductions by the Trump Organization for hotel projects in Vancouver and Hawaii.” Even while declaring losses, Trump took tax deductions on expenses “including residences, aircraft and $70,000 in hairstyling for television,” the Times reported.

On Sunday, Trump tweeted TWTR, 3.60% : “FAKE NEWS!”

But what about the rest of Americans? Who pays no federal tax? Approximately 75.5 million or 43.3% of tax-filing households don’t pay any federal income tax, according to estimates from the Tax Policy Center, a nonprofit joint venture by the Urban Institute and Brookings Institution, which are Washington, D.C.-based think tanks. That’s below the 50% peak during the Great Recession.

An important caveat: Those people obviously still pay sales tax, property taxes and other taxes.

They take personal exemptions, the standard deduction, zero bracket amounts, and more recently, tax credits. But for the most part, they don’t earn enough money, and many people who work and who don’t owe any federal income taxes still give money to Uncle Sam, because money comes out of their paychecks for Social Security and Medicare. “The large percentage of people who don’t owe federal income tax is a feature, not a bug, of the revenue code,” according to the Tax Policy Center.

Many low- and below-average-income families pay more in payroll taxes than they pay in federal income taxes.

Many low- and below-average-income families pay more in payroll taxes every year than they pay in federal income taxes, according to Gary Burtless, a senior fellow at the Brookings Institution, a centrist research group founded in 1916. For the most part, he said, the U.S. individual income tax is progressive, with much heavier tax liabilities as you move up the income distribution, and very low or negative income tax liabilities at the bottom of the income distribution.

Don Fullerton, a professor of finance at the University of Illinois at Urbana-Champaign, analyzed the Tax Policy Center figures more closely. “Older individuals are much more likely than younger individuals to pay no tax or to receive transfers,” he said. “In fact, they receive the bulk of transfers because of their receipt of Social Security benefits.” He found that 11% of people aged 25 to 55 pay no federal income tax, compared to 48% of those above 55, and 80% of those 75 or older.

“Younger individuals are more likely to receive transfers other than Social Security, largely because of unemployment insurance benefits that accrue only to working-age individuals,” Fullerton added. Non-Social Security transfers are received by 11% of those under 60, and 6% of those 60 or older. Those under 60 who receive transfers receive an average of $4,734, while those 60 and older receive average annual benefits of $9,977. “Social Security benefits account for the bulk of the difference,” he said.

“The progressive rate structure of the federal income tax system compresses the after-tax income distribution, so it effectively makes the income tax work like insurance,” Fullerton wrote. “We pay a premium — owing more tax in good years — to retain a higher fraction of our income in bad years. How we value this insurance aspect of the income tax system can depend on how often we find ourselves not owing federal income tax.”

“Although substantial shares of the U.S. population do not owe tax or do receive transfers in a given year, only a small subset of those individuals remain in those states,” he added. “Nearly half of individuals not owing tax will pay taxes within two years, and roughly four-fifths have paid tax within 10 years. Of those who receive transfers other than Social Security, almost half do not receive those transfers the following year, and nearly 90% have stopped receiving the transfers six years later.”

How do voters feel about this? All but the top 20% of families pay more in payroll taxes than in federal income taxes, according to Treasury Department data cited by the Pew Research Center, a nonpartisan think tank in Washington, D.C. Some 64% of Republicans and Republican-leaning independents say the current U.S. tax system is “very or moderately fair,” while just half as many Democrats and Democratic leaners (32%) view the tax system as fair, the 2019 survey found.

Only about a third of Americans approve of Trump’s 2017 tax revamp. “While increasing shares of Democrats say they are bothered ‘a lot’ by the feeling that some corporations and wealthy people do not pay their fair share in taxes (79% of Democrats say this), Republicans’ concerns over these issues have lessened,” Pew said. “Today, 42% of Republicans say they are bothered a lot by the feeling that some corporations do not pay their fair share of taxes (down from 55% in 2015).”

Higher-income taxpayers reaped the largest tax savings from the 2017 Tax Cuts and Jobs Act. Their individual tax rates were significantly reduced.

But it spelled bad news for those who live in a high-tax state and have a high amount of home-mortgage debt: The tax revamp imposed new limitations on itemized deductions for state and local taxes and home-mortgage interest expense; 32% of those earning less than $30,000 got a tax cut, versus 89.5% of those earning $100,000.
