Abortion is one thing, gay marriage is another. 


The only thing they do have in common -- as Cruz factually points out--

 these so called constitutional rights were originally established by judicial fiat 

not by state legislatures.. or even a FEDERAL Legislsture!


And the point is,

Abortion laws can now be modified at any time by state legislatures-- For future abortions

but

previous Gay Marriage licenses issued by the states in the past

can't now be rescinded  -

-the doctrine of "Stare Decisis" won't allow state legislatures to overturn previously accepted gay marriages

and as long a those exist they must accept future gay marriages. 

That said, a Federal Law must be passed modifying the UCCJEA Uniform Child Custody Jurisdiction Enforcement  Act) for gay parental rights and custody issues, if they are to be recognized the same  by all 50 states (as they are for heterosexual marriage.)

And the big obstacle there is political.. you can't get Congress to vote on anything but spending more money!

as well as bilological.. UCCJEA recognizes the priority of biological parents, over the rights of adoptive parents, unless the former is revoked  or surrendered  by due proces under very specific circumstances.

in other words

until either you or Buddha give birth to a actual baby, Jetsheep

Someone,  somewhere, will be the "biological parent" of an adopted child with FEDERAL rights under UCCJEA

Or is marriage purely a religious rite?

What if there is no ceremony, no 'license', no operation of the state in the process of marriage? That is, what about 'common law' marriages?

Is it essentially a contract between people?

If so, why is differing sexes between partners an interest of the state? 

 

Why do you fear homosexuals? That attitude shapes every word of your response.

 

I love the assertion by a TrumpeRINO frog boy that all rights are conferred by law, there are no 'god-given rights'.

Please explain to us why marriage is only between a man and a woman?

I have no issue with taking away the word "Marriage" from the federal and make the federal part a "union"; if you want to get married in a church, your choice. Since when are we in the business of granting legal protection and distinction for "marriage", where the government should not be making laws with respect to any particular religion? Blurring the line a bit flipper?

Some married people have children, some don't. Some un-married people have children, some don't.

Marriage is about two people committing to each other to be a couple, it makes no difference what sex the two people are. 

So that Bitch Homophobe Cruz saying that marriage must be decided by the states should mean all marriages. I think his idea about having states decide marriage laws is about as stupid as he is. They should be universal nationwide, people move all over the place both getting married and divorced, you can't have a patchwork of different laws in every state.

But if he insists on having it that way then it must be for ALL marriages, you can't discriminate!
