If the assailant is not threatening you with a weapon, and you don't feel your life is in danger, you are not legally allowed to use deadly force. This is one of the most basic laws of use of force in both law enforcement and personal protection.
You cannot kill someone to protect your property; that's not the way the law is written.
I repeat, if you don't believe your life is at danger, you cannot respond with deadly force.
